1. Introduction

ByDay ("we", "us", or "our") is a freelance services marketplace connecting customers, skilled professionals, and businesses across Ghana. This Privacy Policy explains how we collect, use, disclose, and safeguard your personal information when you use our website and mobile application (available on iOS and Android) (collectively, the "Platform"). By using the Platform, you consent to the practices described in this policy.

2. Information We Collect

2.1 Information you provide directly:

  • Account details: name, email address, phone number, and password.
  • Professional profile: bio, service category, location (city/area in Ghana), skills, service packages, hourly rate, years of experience, business registration status, certifications, insurance status, and profile photo.
  • KYC (Know Your Customer) data: government-issued ID type, ID number, live camera capture of the front of your ID (and back for Ghana Card), and a live selfie holding your ID. These images are captured in real-time via your device camera and are AI-verified for clarity and authenticity.
  • Job requests: service title, description, category, preferred date, location, and budget range.
  • Bookings: service details, date and time, location, notes, payment information, GPS coordinates (latitude/longitude) for the booking location, and multi-day end dates where applicable.
  • Quotes: pricing, messages, and proposal details submitted by professionals in response to job requests.
  • Reviews and ratings: star ratings and written comments you submit about professionals or services.
  • Messages: content of in-app messages exchanged between customers and professionals, including pre-booking direct chats and booking-related communications. Messages are scanned for personally identifiable information (PII) such as phone numbers and email addresses.
  • Payout information: mobile money number, network provider, bank account details, and account name (for professionals requesting payouts).
  • Referral data: referral codes you share or use, the associated referral relationships, your IP address, and browser/device fingerprint at the time of signup (used for fraud detection).
  • Work photos and documents: photos of your work and uploaded verification documents (for professional profiles).
  • Availability settings: your working hours, blackout dates, blocked time slots, advance notice preferences, and availability toggle status (for professionals).
  • Check-in data: GPS coordinates and timestamps recorded when a Pro checks in or checks out at a job location, along with customer confirmations of arrival and departure.
  • Dispute information: reasons, evidence, and communications related to disputes you raise or are involved in, including dispute resolution messages.
  • Safety reports: the category, priority, details, and associated booking/pro information you submit when filing a safety concern.
  • Support communications: messages, feedback, and requests you send to our support team.
  • Business profile data: company name, industry, location, phone, contact email, website, logo, business description, and uploaded business registration documents (for users registering as a business).
  • Business listings: details of service jobs and employment roles you post, including title, description, category, location, budget or salary range, and preferred date.
  • Quotes and applications: quotes you submit on business service jobs (amount and message), and applications you submit to employment listings (your name, phone, profile link, and cover note).
  • Promotion purchases: the promotion tier, amount paid, Paystack transaction reference, start and expiry dates, and status of any paid featured-slot promotion you purchase as a verified professional.

2.2 Information collected automatically:

  • Device information: device type, operating system, and browser type.
  • Usage data: pages visited, features used, search queries, and timestamps.
  • Location data: approximate location derived from your IP address; precise GPS location when you use the "Search Near Me" feature or when a Pro checks in/out at a job location (only with your permission).
  • Cookies and similar tracking technologies.

2.3 Information from third-party login services:

If you sign in using a third-party service such as Sign in with Apple or Google, we receive only your name and email address as provided by that service. We do not receive your password or any additional data. When you use Sign in with Apple and choose to hide your email, we receive a private relay email address instead. We do not use third-party login data for advertising purposes.

3. How We Use Your Information

We use your information to:

  • Create and manage your account and provide access to all Platform features.
  • Verify the identity of service professionals through the KYC process, including AI-assisted image quality checks.
  • Display professional profiles, services, packages, availability, safety verification badges, and ratings to potential customers.
  • Facilitate job requests, quotes, bookings, and service delivery.
  • Process escrow payments, hold funds during disputes, and release funds to professionals upon job completion.
  • Process the 15% Pro booking unlock fee and gate sensitive booking details until payment is confirmed.
  • Track Pro check-in/check-out via GPS to verify service delivery and support accountability.
  • Handle disputes, safety reports, and payout requests through our admin team.
  • Enable in-app messaging between customers and professionals, including PII detection and off-platform communication prevention.
  • Send transactional notifications, booking confirmations, rating reminders, renewal reminders, and system updates.
  • Manage referral programmes, detect referral fraud, and issue referral rewards.
  • Apply and validate discount coupons.
  • Allow administrators to register and manage Pro profiles manually when needed.
  • Verify business accounts, review business registration documents, and approve or reject business listings.
  • Facilitate business service jobs and employment roles, including quotes from artisans/pros and job applications.
  • Process paid promotion purchases and display promoted profiles in sponsored placements on the Home page and at the top of Explore results.
  • Provide AI-powered concierge, booking, matching, and interview assistant features.
  • Improve the Platform's features, functionality, and user experience.
  • Detect, prevent, and investigate fraud, abuse, or violations of our Terms of Service.
  • Comply with applicable legal obligations.

4. How We Share Your Information

We do not sell your personal data. We may share your information in the following limited circumstances:

  • Between users: Your public professional profile (name, photo, location, category, services, packages, ratings, reviews, and safety verification badge) is visible to other Platform users. Verified business profiles (company name, logo, industry, location, and verified badge) are also public. A "Sponsored" badge is shown on profiles with an active paid promotion, and promoted profiles are displayed in sponsored placements on the Home page and at the top of Explore results. Booking details, job request information, business listings, and messages are shared with the directly relevant party (customer, professional, or business). Full booking details (location, notes) are only revealed to a Pro after they pay the 15% unlock fee. Quotes on business service jobs and applications to employment listings are shared with the relevant business.
  • Payment processing: We use Paystack to process escrow payments, Pro unlock fees, and other transactions. Your payment transaction data is processed by Paystack in accordance with their privacy policy. We store only payment references and statuses — we do not store full card numbers.
  • Service providers: We share data with third-party providers who help us operate the Platform (e.g., cloud hosting, email delivery, push notifications, AI model providers), subject to confidentiality agreements.
  • Administrative access: Authorised ByDay administrators have access to all user data as necessary to operate the Platform, review KYC documents, resolve disputes, process payouts, investigate safety reports, and ensure compliance.
  • Legal compliance: We may disclose your information if required by law, court order, or government authority.
  • Business transfers: In the event of a merger, acquisition, or sale of assets, your data may be transferred to the successor entity.

5. Payments, Escrow & Unlock Fees

ByDay uses Paystack as its payment provider to process booking payments securely. When a customer makes a payment, funds are held in escrow by ByDay until the job is confirmed as complete. At that point, funds are released to the professional. In the event of a dispute, funds remain locked until the dispute is resolved by our admin team. Pros must pay a 15% unlock fee via Paystack to access full booking details before commencing work. Payout requests from professionals are processed manually by our team via mobile money or bank transfer. Paid promotion fees are also processed through Paystack. We retain transaction references and amounts for accounting and legal purposes.

6. KYC Verification & Camera Data

Identity documents submitted for KYC verification — including ID type, ID number, live-captured ID photos (front and back where applicable), and live selfies — are used solely to verify your identity as a service professional. These images are captured in real-time through your device camera and may be analysed by AI to confirm they are clear, readable, and authentic. KYC data is stored securely and is accessible only to ByDay's authorised administrators. We do not share your KYC documents with customers, other professionals, or any third parties, except where required by law.

7. Messaging & PII Detection

Messages sent through the Platform between customers and professionals are stored to enable ongoing communication and to assist in dispute resolution if necessary. Our system automatically scans messages for personally identifiable information (PII) such as phone numbers, email addresses, and patterns suggesting attempts to move communication off-platform. Detected PII may result in warnings or blocked messages. Our admin team may review messages in the context of investigating reported disputes or safety concerns. We do not use message content for advertising purposes.

8. Geolocation & Check-In Data

When a Pro checks in or checks out at a job location, their GPS coordinates (latitude and longitude) and the current timestamp are recorded and associated with the booking. This data is used to verify that the Pro was present at the agreed location and to support dispute resolution. For multi-day jobs, daily check-in records are maintained. Customers may be asked to confirm the Pro's arrival and departure. Location data is captured only at the moment of check-in or check-out — ByDay does not continuously track Pro locations. When you use the "Search Near Me" feature, your precise GPS location is processed temporarily in your browser to find nearby professionals and is not permanently stored on our servers. You can disable location permissions in your device settings at any time.

9. Safety Reports

When you submit a safety report, we collect the reported user's email, associated booking or pro profile ID, the category of concern (e.g., harassment, theft, scam), priority level, and your detailed description. Safety reports are accessible only to ByDay administrators and are used to investigate and address safety concerns. Urgent-priority reports may trigger immediate admin alerts. Safety report data is retained for as long as necessary for investigation and compliance purposes. Pros who have passed verification display a safety verification badge on their profile.

10. Referral Programme

When you participate in the ByDay referral programme, we collect and store your referral code, the email and ID of users you refer, and the status and outcome of each referral. We use device fingerprinting and IP address information to detect and prevent referral abuse (e.g., self-referrals from the same device). Referral rewards are issued only for verified, legitimate referrals that result in a completed first job.

11. AI Features & Concierge

ByDay offers AI-powered features including a Concierge assistant, booking assistant, job request interviewer, and pro matchmaker. Conversations with these agents may be stored and used to improve matching quality and service delivery. AI agents may access your Platform data (e.g., job requests, profile information) to provide relevant assistance. We do not use AI conversation data for advertising. You can request deletion of your conversation history by contacting us at privacy@bydaygh.app.

12. Calendar Integration

ByDay provides an optional "Add to Google Calendar" link for confirmed bookings. This feature generates a URL with pre-filled event details that opens Google Calendar in your browser. ByDay does not access, store, or process your Google Calendar data. No OAuth authentication or data exchange occurs — the integration is limited to generating a calendar event link.

13. Notifications

We send in-app and email notifications for events such as new quotes on your job request, booking confirmations and status changes, rating reminders after completed bookings, referral rewards, renewal reminders for professional memberships, and urgent safety alerts. You may manage notification preferences from your device settings. Transactional notifications necessary for service delivery cannot be disabled.

14. Data Retention

We retain your personal information for as long as your account is active or as needed to provide our services. If you delete your account, we will delete or anonymise your personal data within 30 days, except where we are required to retain it by law (e.g., financial transaction records, KYC documents, legal dispute records). Check-in GPS data and dispute records may be retained for longer periods for audit and legal compliance. Some data may remain in encrypted backups for up to 90 days after deletion.

15. Data Security

We implement industry-standard security measures, including encryption in transit (HTTPS/TLS), access controls, and role-based permissions, to protect your personal data. Payment data is processed entirely through Paystack's PCI-DSS compliant infrastructure. KYC images are AI-verified and stored with restricted administrative access. However, no method of internet transmission is 100% secure, and we cannot guarantee absolute security.

16. Your Rights and Account Deletion

Subject to applicable law, you have the right to:

  • Access: Request a copy of the personal data we hold about you.
  • Correction: Request correction of inaccurate or incomplete data.
  • Deletion: Permanently delete your account and all associated data. You can do this directly from your Dashboard → scroll to the bottom → tap "Delete Account". Deletion is immediate and irreversible.
  • Objection: Object to certain types of processing, such as direct marketing.
  • Portability: Request a structured, machine-readable copy of your data.
  • Restrict processing: Request that we limit how we use your data in certain circumstances.

17. Cookies

We use cookies and similar technologies to maintain your session, remember your preferences, and analyse Platform usage. We do not use cookies for targeted advertising. You can control cookie settings through your browser. Disabling cookies may affect certain features of the Platform.

18. Children's Privacy

ByDay is not directed at children under the age of 18. We do not knowingly collect personal information from minors. If you believe a minor has provided us with their data, please contact us and we will delete it promptly.

19. Third-Party Links

The Platform may contain links to third-party websites or services, including the Apple App Store, Google Play Store, Google Calendar, and Paystack. We are not responsible for the privacy practices of those third parties. We encourage you to read their privacy policies before providing any personal information.

20. Changes to This Policy

We may update this Privacy Policy from time to time. We will notify you of significant changes by posting a notice on the Platform or sending you an email. The "Last updated" date at the top of this page reflects when the policy was last revised. Your continued use of the Platform following the update constitutes your acceptance of the revised policy.
